Inquiry into the Migration Amendment (Prohibiting Items in Immigration Detention Facilities) Bill 2017 [Provisions]

The Bill amends the Migration Act 1958 (Cth) to empower the Minister for Immigration and Border Protection to ban mobile phones and other items in immigration detention centres. It also expands immigration officers’ warrantless search and seizure powers, and authorises them to use dogs to search detainees and visitors.

Increasing arrest times a danger: rights group

Australians should be shaken by the Federal Government’s use of the term executive detention, Liberty Victoria said today. 
 
The human rights group said the plan to hold suspects for a fortnight without charge plays into the hands of terror groups while being aimed at stopping them. 
 
“Such a curtailment of people’s hard-fought freedom is a big step down the wrong road,” said Liberty president Jessie Taylor. 
 

Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment

We support the Commonwealth Government’s commitment to ratify the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (OPCAT).

The Victorian Charter of Human Rights and Responsibilities Act 2006 (Vic) (the Charter) imposes human rights obligations on every public authority in Victoria.  Relevantly for present purposes, s 10 of the Charter provides that:

A person must not be—

(a) subjected to torture; or

(b) treated or punished in a cruel, inhuman or degrading way; or

Government should reject calls for a more punitive approach to child prisoners, and should focus on the promotion of the rehabilitation of children and the removal of children from detention.

Locking teenagers in adult jails both dangerous and wrong

Teenagers don't belong in an adult jail, even when things get hard. Placing them with adult prisoners is exposing them to dangerous influences and the risk of abuse.

No safety in plan to jail more - Liberty

State Government plans to jail more people will not make Victorians safer, rights group Liberty Victoria warned today. 

"Practical experience of the criminal justice system has long shown that in many cases offenders who are imprisoned pose a greater risk to the community upon release due to the harmful effects of jail," said Liberty Victoria Vice President, Michael Stanton.

"That is especially the case with youthful offenders."

The right to liberty, and the associated right to humane treatment while being deprived of liberty, are core tenets of Liberty Victoria[1] and are also enshrined under international human rights law.[2]
