Liberty Victoria welcomes the decision handed down by the Full Federal Court today concerning the Biloela family. A unanimous Full Federal Court has upheld the earlier decision of the Honourable Justice Moshinsky that the Minister for Home Affairs denied the youngest child of the Biloela family procedural fairness in the assessment of whether she engaged Australia’s international non-refoulement obligations.
We now call on the Minister to provide redress for this long-suffering family – a family who have been embraced by the Australian community – by exercising his powers to grant them visas to remain in this country. We ask that the Minister bring them home.
President of Liberty Victoria, Julia Kretzenbacher, said:
“The family has now been held by the Australian government in onshore immigration detention for over 1,000 days and we have profound concerns for the immense ongoing significant harm this is causing the family members, particularly the two young children whose physical and mental vulnerabilities have been well documented by the media.”
“Tharnicaa and Kopica are currently the only children that Australia is holding in onshore detention. This is not a place where children should be detained.”
